These Terms of Service ("Terms") govern your access to and use of the services provided by Mintink Sports Cards Inc., a company registered in the Province of Ontario, Canada. Mintink Sports Cards Inc. owns and operates its websites, online stores, mobile services, retail services, and any related features or transactions (collectively, the "Services").

By accessing or using our Services or purchasing products or services from Mintink Sports Cards, you agree to these Terms and any policies referenced within them.

1. Introduction & Eligibility

By using our Services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

By using our Services, you confirm that you have the legal capacity to enter into this agreement or, where applicable, that you are using the Services with the consent of a parent or legal guardian.

2. Orders, Acceptance & Availability

Placing an order with Mintink Sports Cards does not guarantee acceptance or availability of the product. Orders are subject to product availability, inventory verification, payment authorization, applicable purchase limits, and our acceptance of the order.

Mintink Sports Cards reserves the right, subject to applicable law, to refuse, limit or cancel an order where reasonably necessary, including in cases involving:

·         Product or inventory errors;

·         Pricing, listing or description errors;

·         Product allocation or availability issues;

·         Suspected fraud or unauthorized transactions;

·         Misuse of promotional offers or discount codes;

·         Attempts to circumvent product or quantity limits; or

·         Other circumstances that reasonably prevent us from fulfilling an order.

If Mintink Sports Cards cancels an order after payment has been processed, the applicable amount paid for the cancelled item or order will be refunded to the original method of payment, except where otherwise agreed or permitted by applicable law.

3. Return, Refund & Exchange Policy

Purchases of physical products are subject to our Return, Refund, and Exchange Policy, which forms part of these Terms and outlines the conditions under which products may be returned or exchanged.

Certain products, including products identified as Final Sale, may not be eligible for return, refund or exchange except where required by applicable law.

Fees for services, including grading, customization or other services, are non-refundable once the applicable service has commenced unless otherwise stated or required by applicable law.

4. Pre-Orders

All pre-orders are subject to our Pre-Order Information and Policy, which forms part of these Terms.

Pre-order products may be offered in limited quantities and may be subject to manufacturer or distributor allocations. Unless otherwise stated in our Pre-Order Policy or required by applicable law, cancellations or reductions in quantities of pre-orders are not permitted once an order has been placed.

Product release dates are estimates and may change due to manufacturer, distributor, production, allocation, shipping or other circumstances outside Mintink Sports Cards' reasonable control. A change or delay in a release date does not, by itself, provide a right to cancel a pre-order except where otherwise provided in our Pre-Order Policy or required by applicable law.

Any applicable pre-order price protection is governed by our Pre-Order Policy.

5. Pricing, Product Information & Errors

We make reasonable efforts to ensure that product descriptions, images, pricing and other information displayed through our Services are accurate. However, errors may occasionally occur.

Prices and availability are subject to change without notice, except where otherwise required by applicable law or where an order has already been accepted at an agreed price.

If a product is listed at an incorrect price or contains materially incorrect information due to a typographical, technical, system or other error, Mintink Sports Cards reserves the right, subject to applicable law, to correct the error and, where appropriate, cancel the affected order and issue a refund.

Product images are provided for reference and may not always represent the exact item received where variations are inherent to the product.

6. Promo Codes & Discounts

Promotional codes and discounts must be applied at checkout and cannot be added after a purchase is completed unless otherwise expressly stated.

Discounts cannot be combined unless explicitly permitted. Promotions may be subject to additional terms, including expiration dates, eligible products, minimum purchase requirements, quantity limits and usage limits.

Misuse of promotional codes, including fraudulent activity, unauthorized distribution or attempts to circumvent promotional restrictions, may result in cancellation of the applicable discount or order and, where appropriate, restrictions on an account.

Mintink Sports Cards reserves the right to modify, suspend or cancel promotions, subject to applicable law.

7. Shipping & Delivery

Orders requiring shipment are subject to our Shipping Policy, which forms part of these Terms.

Customers are responsible for providing complete and accurate shipping information at checkout. Mintink Sports Cards is not responsible for delays resulting from incorrect or incomplete information supplied by the customer.

Delivery dates and shipping estimates are estimates only unless expressly stated otherwise. Carrier delays, customs processing, weather events and other circumstances outside Mintink Sports Cards' reasonable control may affect delivery times.

Nothing in this section limits any rights or remedies available to consumers under applicable law.

8. Modifications to These Terms

Mintink Sports Cards may update these Terms from time to time to reflect changes to our Services, policies, business practices or legal requirements.

Updated Terms will be posted through our Services with a revised "Last updated" date. Where required by applicable law, we will provide additional notice of material changes.

Your continued use of the Services following the effective date of revised Terms constitutes acceptance of those Terms to the extent permitted by applicable law.

9. Prohibited Activities

You agree not to use our Services for unlawful, fraudulent, abusive or unauthorized purposes.

Prohibited activities include, without limitation, fraud, money laundering, payment fraud, unauthorized transactions, attempts to interfere with or compromise our systems, misuse of promotional offers, or other activities prohibited by applicable laws or regulations.

10. Account Security

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account.

You must notify Mintink Sports Cards promptly if you become aware of unauthorized access to or use of your account.

11. Mobile Messaging Service

a. Consent to SMS/Text Messages: By consenting to Mintink Sports Cards' SMS/text messaging service, you agree to receive recurring SMS/text messages, including updates, alerts, promotions and marketing offers, from or on behalf of Mintink Sports Cards.

b. Voluntary Participation: Participation in our SMS/text messaging program is voluntary and is not a condition of purchasing our products or using our Services.

c. Message and Data Rates: Mintink Sports Cards does not charge for participation in the messaging service; however, standard message and data rates imposed by your wireless provider may apply. Message frequency may vary.

d. Opt-Out: You may opt out of marketing text messages at any time by texting STOP to +1 866-913-4612 or by using an unsubscribe mechanism provided in an applicable message. You may receive a confirmation message following your opt-out request.

12. Cryptocurrency Transactions

Where Mintink Sports Cards permits payment or transactions using cryptocurrency:

a. Risk Acknowledgment: You acknowledge that cryptocurrency transactions may involve risks, including price volatility, regulatory uncertainty and technical vulnerabilities.

b. Transaction Responsibility: Cryptocurrency transactions may be irreversible. Customers are responsible for ensuring that transaction details are accurate before submitting a transaction.

To the fullest extent permitted by applicable law, Mintink Sports Cards is not responsible for losses resulting solely from cryptocurrency price fluctuations, customer transaction errors, unauthorized access to a customer's cryptocurrency wallet, or circumstances outside Mintink Sports Cards' reasonable control.

13. Intellectual Property

All content made available through our Services, including text, graphics, photographs, images, videos, logos, trademarks, designs and other content, is owned by or licensed to Mintink Sports Cards and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publish, commercially exploit or create derivative works from our content without our prior written permission, except as otherwise permitted by law.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Mintink Sports Cards Inc. will not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your use of the Services, products or services.

Nothing in these Terms excludes, restricts or modifies any warranty, condition, right or remedy that cannot lawfully be excluded, restricted or modified under applicable consumer protection legislation or other applicable law.

15. Privacy Policy

Our collection, use, disclosure and protection of personal information are governed by our Privacy Policy, which forms part of these Terms.

By using our Services, you acknowledge that your personal information will be handled in accordance with our Privacy Policy and applicable privacy laws.

16. Termination & Suspension

Mintink Sports Cards may suspend or terminate access to an account or the Services where we reasonably determine that a user has violated these Terms, engaged in fraudulent or unlawful activity, misused our Services, or created a security risk.

Termination or suspension of an account does not affect rights or obligations relating to transactions completed before termination, except where otherwise permitted or required by applicable law.

17. Third-Party Services

Our Services may contain links to or integrate with third-party websites, payment providers, shipping carriers, social media platforms or other services that are not owned or controlled by Mintink Sports Cards.

Mintink Sports Cards is not responsible for the content, privacy practices, availability or independent actions of third-party services. Your use of third-party services may also be subject to their own terms and policies.

18. Governing Law

These Terms and any dispute or claim arising from or relating to them or your use of the Services are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

Subject to any rights or remedies available under applicable consumer protection legislation, the parties agree that disputes relating to these Terms or the Services will be determined by the courts of competent jurisdiction in Ontario, Canada.
